Do I Need a Permit for Tree Removal in Kentucky?

Do I Need a Permit to Remove a Tree?

The only time that you need a permit for Kentucky tree removal is if your tree is partially within a public space, such as an easement area along a sidewalk. That is, if you have a tree that inhabits a space that is composed of both your property and public property then it may not be entirely your decision to remove it.

When this is the case, you should call 311 and request a permit. The onus for obtaining a permit for tree removal is something that falls on the homeowner, not the tree removal service.

What about Parkway Trees?

Parkway trees can never be removed or pruned by a homeowner. These trees are considered park trees and are maintained by the Metro Parks Department. If you live on one of our famous parkways, Southern, Eastern, Algonquin, Northwestern, or Southwestern, you should be aware that the trees along the roadway are considered part of the parks system. These trees are typically planted in a straight line along the road, and may be upwards of 50’ away from the road. What About a Tree on my Neighbor’s Property?

When the conversation of permits for tree removal comes up, homeowners also sometimes have questions about a “shared” tree with a neighbor. 

This is another one of those situations that can get confusing. While a tree might originate in your neighbor’s yard, you might have one or more branches hanging into your yard.

In Kentucky, we must follow the “Massachusetts Rule” in regard to tree removal, which was adopted in 1985.

This rule says that it is not the responsibility of a property owner to deal with roots or limbs that extend from their tree, over a property line. 

That means if you have a limb hanging over your yard that belongs to your neighbor’s tree, and you want it down, it is not their responsibility. However, you do have the right to remove that limb yourself. But you can only cut a limb up to the property line.

This rule can make decisions around Kentucky tree removal (or limb removal) frustrating but we’ve found that the vast majority of the time, amicable neighbors come to an agreement that works for everyone.
